Definitions

1. The term "Wangog.pl" means the company wangog.pl Robert Biernat, which is a sole proprietorship with its registered office in Chyliczki, at ul. Letnia 16, entered into the Central Register and Information on Business Activity, identified by the Tax Identification Number (NIP) 5211337466 and the National Business Registry Number (REGON) 389084521.
2. The term "Price List" means the list of fees related to the functioning of the Agreement.
3. The term "Domain" means one of the top-level domains of the worldwide domain system, entered in the database of the Internet Assigned Numbers Authority.
4. The term "Working Day" means every day excluding Saturdays and days recognized as statutory holidays in Poland.
5. The term "Website" means the website https://wangog.pl.
6. The term "Website" means a website on the World Wide Web designed, created and maintained by Wangog.pl for the User under the concluded Agreement, based on the wildcard domain address https://*.wangog.pl.
7. The term "Alias" means an identifier that is part of the domain address of the Website after removing the https:// character string on the left and .wangog.pl on the right.
8. The term "User" means a natural person who creates an Account on the Website and who may conclude one or more Agreements.
9. The term "Promotional Coupon" means a six-digit code (sequence of letters and numbers) received from Wangog.pl in any form, enabling a discount when concluding the Agreement.
10. The term "Consumer" means a User who has concluded one or more Agreements. 
11. The term "Agreement" means the agreement between the User and Wangog.pl regarding the design, implementation and maintenance of the Website.
12. The term "Minor Change" means a minor functional change to the Website consisting of a change to the content or appearance of a single section of the Website.
13. The term "Major Change" means a comprehensive functional change to the Website that involves changing the content or appearance of most or all of the Website.
14. The term "Maintenance Period" of the website means the period starting from the date of conclusion of the Agreement and ending on the Website Validity Date, during which Wangog.pl maintains the User's Website.
15. The term "Account" means an account on the Website belonging to the User, identified by an email address and secured with a password. 
16. The term "Business Card" means one of the four types of Websites available on the Website: A website constituting a business card of the User or a business card of his/her business activity, consisting of one subpage.
17. The term "Multi-Page Website" means one of the four types of Websites available on the Website: a full Website supporting the user's business activity consisting of multiple subpages.
18. The term "Online Store" means one of the four types of Websites available on the Website: A website enabling the sale of products or services online.
19. The term "Blog" means one of the four types of Websites available on the Website: personal internet blog.
20. The term "Survey" means a survey completed by the User after concluding the Agreement, the purpose of which is to determine the User's requirements regarding the content and appearance of the Website.
21. The term "Website Maintenance" means all technical activities on the part of Wangog.pl aimed at ensuring the availability of the Website on the World Wide Web and its proper operation, making changes to the content and appearance of the website and removing irregularities in the operation of the Website.
22. The term "User Panel" means the functionality available on the Website after logging in to the Account, through which the User can operate the Websites. 
23. The term "Regulations" means these regulations.
24. The term "Expiration Date" of a page means the end date of the Page's Validity Period, which is set as the date of the User's acceptance of the page plus 1 year from the time of the User's acceptance of the page. The Page's Validity Date may be extended by paying a fee to extend the Page's Validity Period.
25. The term "Page ID" means the unique, numerical identifier of a User's Page.
26. The term "Force Majeure" means an event beyond the control of Wangog.pl, external, impossible to predict and prevent even with the utmost care.

Account

27. Any natural person may create an Account on the Website.
28. Maintaining and maintaining an Account on the Website is free of charge.
29. To create an account, only the User's email address is required.
30. By creating an Account, the User consents to the processing of his/her email address by Wangog.pl.
31. The user can provide their email address via Facebook login, Google login or by directly entering the email address in the form. 
32. When creating an Account, the Website verifies that the User is the owner of the provided email address. Verification is performed via Facebook login, Google login, or by sending a four-digit identifier to the User's provided email address and entering the received identifier in the Website form.
33. The user's email address is a unique user identifier.
34. When creating an account via direct email entry, the User sets their own password. The password must meet the following requirements:
a. must consist of at least eight characters, each of which is a letter of the English alphabet, a number or a special character from the set ?!@#$%^&*()
b. must contain at least one digit
c. must contain at least one capital letter
d. must contain at least one lowercase letter
e. must contain at least one special character.
35. The User is obligated to keep the password secure and not disclose it to third parties. Wangog.pl is not responsible for the consequences of the User disclosing the password to third parties.
36. The User can log in to the account using one of three methods: Facebook login, Google login, email address and password.
37. The User may change or enter the password after logging in to the Website.
38. The User may recover the password to the Website by selecting the option "Give or recover password" visible on the login screen via email.
39. After logging in to the website, the user has access to the following functionalities:
a. changing/entering personal data
b. change login password
c. login history overview
d. password change history review
e. operation of User's Websites - each Website has a separate panel
f. chat with a Wangog.pl consultant
g. list of payments made
h. purchase of the Website.

Agreement

40. The User may conclude an Agreement with Wangog.pl.
41. The Agreement covers the design, implementation and maintenance of one Website for the first year.
42. The User may conclude multiple separate Agreements for different parties.
43. The conclusion of the Agreement is equivalent and takes place at the moment of purchasing the Website on the Website by the User based on the current Price List available on the Website in the Price List tab.
44. The Agreement is conducted on the basis of the principles described in these Regulations.
45. Under the Agreement, Wangog.pl undertakes to:
a. Development of the website design
b. Creation of a website based on a proprietary CMS
c. Maintaining the website for the first year from the date of acceptance of the website design by the User
d. Creation of a Google business card if the user selects this option in the Survey
e. One Major Change and three Minor Changes in each Maintenance year, at no additional charge
f. Ensuring the availability of the User's website in the *.wangog.pl Domain
46. At the time of conclusion of the Agreement, the system automatically creates an Account for the User on the Website, unless the User already has an account on the Website.
47. After concluding the Agreement, the Website is built in the following steps:
In the first step, the User completes a Survey specifying the requirements for the Website. If the User provides photos to Wangog.pl in the Survey, they will include a declaration that they own the rights to them, meaning that they took them themselves or have the appropriate license to use them on the web. The Survey is available in the User Panel. After completion, the User submits the Survey to Wangog.pl from the User Panel. If the Survey is submitted to Wangog.pl no later than 14 days from the date of conclusion of the Agreement, the User may, when submitting the Survey, select the option to waive their right to withdraw from the Agreement. If the User selects this option, Wangog.pl will design and develop the Website within a maximum of 7 Business Days from the date the Survey is submitted to Wangog.pl, otherwise, within a maximum of 21 days from the date of conclusion of the Agreement.
b. In the second step, Wangog.pl develops the project and creates the Website based on the submitted Survey, and then sends information about the completion of the project to the User via the chat available in the system and email notification.  
c. In the third step, the User approves the project using the option available in the User Panel or submits comments on the project via chat. If comments are submitted, Wangog.pl consultants review the comments and provide information on their resolution via chat. Wangog.pl consultants and the User work in partnership to efficiently finalize the project.
d. In the fourth step, the Website is made available on the World Wide Web and the Page Expiration Date is set as the date of acceptance of the page by the User plus 1 year.
48. Wangog.pl is responsible for changes to the content and appearance of the Website, as well as for the configuration and parameterization of the website, with the exception of the areas listed below, for which the User is responsible. The User manages these areas using the tools provided by Wangog.pl in the User Panel. List of areas:
a. Contact form support
b. Chat support with User's clients
c. Newsletter Service
d. Blog support
e. Changing selected parameters
f. Warehouse management, goods records, settlements (applies to the Online Store)
49. During each year of the Agreement, the User has the right to request three free Minor Changes and one free Major Change from Wangog.pl. Subsequent Minor Changes (starting with the fourth) and Major Changes (starting with the second) are payable in accordance with the Price List. During the first, annual term of the Agreement, the first Major Change may be requested no earlier than six months after the expiry of the first six months. The User requests changes via chat. Payments for changes are made after Wangog.pl has completed the changes. The User does not have the right to withdraw from payment for the completed change.
50. The User may extend the Agreement by selecting the online payment option available in the User Control Panel. Online extensions can be made by 1 month or 12 months. The extension fee is listed in the Price List. Once the payment is accepted, the website's expiration date is extended by 1 or 12 months, respectively. Extensions are not available if there are outstanding payments for changes made to the website.
51. The User may extend the Agreement by selecting the payment option via traditional bank transfer to the account specified in the User Panel. The User may transfer any amount to the specified account with a note containing the Party's Alias and Party ID. Transfers with incorrectly completed notes will be returned to the sender. Based on the transfer amount, the system will calculate the extension period for the Agreement using the following algorithm:
a. if the transfer amount (A) is a multiple of the amount representing twelve rates for extending the website maintenance by 1 month after the first year with payment for 12 months in the price list (B), the system will extend the Agreement for the period of time according to the formula: A/B*12 months
b. if the transfer amount (A) is a multiple of the amount constituting the rate for extending the website maintenance by 1 month after the first year in the price list (B), the system will extend the Agreement for the period of time according to the formula A/B months
c. if the conditions in points a and b are not met, or there are unpaid payments for changes made on the website, the transfer will be returned to the sender.
52. The User has no right to withdraw from paying for the extension of the website.
53. 14 days and 7 days before the Website Expiration Date, the User will receive a notification that the Website maintenance period is ending. If the User does not pay the fee by the Website Expiration Date, the Website will be blocked on the Website Expiration Date. The message "The Website is blocked due to non-payment" will be displayed. After 30 days from the Website Expiration Date, the Website will be deleted from the system.
54. The User independently assigns an Alias for the Website in the Survey. The Alias must be between 4 and 30 characters long and cannot be used by another Website user. The Alias must consist of the characters a, b, c, d, e, f, g, h, i, j, k, l, m, n, o, p, q, r, s, t, u, v, w, x, y, z, 0, 1, 2, 3, 4, 5, 6, 7, 8, 9, and a hyphen. The first character of the Alias must be a letter.
55. The website is visible on the Internet at the domain address https://[alias].wangog.pl. 
56. The User may use their domain to address the Website. Such settings (redirection) are made by the domain operator.
57. Users may also purchase their own domain through the Website and have the domain configured on the Website to point to the Website. Users have no right to withdraw from the domain payment. The purchase process consists of the following steps:
a. The User sends a chat to the Website in which he/she provides the name of the domain he/she is interested in
b. The Wangog.pl consultant checks whether a given domain is available and sends its price to the User via chat
c. The user sends acceptance of the price via chat
d. The Wangog.pl consultant places an order with the specified price on the Website, which is visible in the User Panel
e. The User pays for the order via the User Panel
f. The Wangog.pl consultant purchases a domain which becomes the property of Wangog.pl and configures the domain to point to the user's Website
g. After a year, 2 weeks before the domain expires, the Website issues an automatic order for payment for another year of the domain's operation and sends information to the User about the need to pay for the domain for the next year.
58. For websites, the User may purchase website positioning services, advertising campaign preparation services, or advertising campaign execution services on the Website. Such services are provided based on the signing of a separate agreement between Wangog.pl and the User. Such agreements are not described in the Terms and Conditions.

Final entries

59. The User undertakes to comply with the provisions of the Regulations.
60. The User is obligated to ensure the confidentiality of the password, not to share the password with third parties, to protect the password from third party access, and to immediately notify Wangog.pl of any instance or suspicion of a third party gaining possession of the password. The User is responsible for the consequences of sharing the login and password or the User Panel with third parties.
61. The User is responsible for any malfunctions of the Website resulting from their culpable action or omission, including improper use of the Website's functionality or integration with external software. The User is responsible for removing any malfunctions or malfunctions in the Website's operation resulting from the circumstances indicated.
62. Wangog.pl reserves the right to make modifications to the Website to ensure proper operation of the Website and to offer Users the best solutions currently available on the market. The modifications referred to in the preceding sentence may consist of improving its parameters or updating the software to a newer version. Wangog.pl will inform Users of the changes described above only if they significantly affect the use of the Website, or if such information is required by mandatory provisions of law.
63. In order to ensure the highest level of performance of the Website and to offer Users the best solutions available on the market at a given time, or when dictated by significant organizational needs, Wangog.pl has the right to modify the Website by transferring it to other physical devices or changing the location of the physical devices on which the Websites are hosted. The right referred to in the preceding sentence may not violate mandatory provisions of law, including in particular provisions regarding the processing of personal data. Wangog.pl informs Users of the changes described in this section only if they significantly affect the use of the Website, or if the information requirement results from mandatory provisions of law.
64. Wangog.pl is liable for any significant lack of website availability, i.e. availability below 95% of the time in a given month. 
65. Subject to mandatory provisions of law and the content of the Regulations, the liability of Wangog.pl is limited to the amount of actual loss and, together with the liability for contractual penalties, may not in any case exceed the amount of the fee paid by the User for maintaining the Website to which the claim for compensation relates, in the last 12 months before the event giving rise to the damage.
66. Wangog.pl maintains the Websites in accordance with the law and does not manage User materials to the extent that there is no legal basis for doing so in generally applicable regulations. Furthermore, Wangog.pl is not the entity responsible for resolving conflicts between Users and third parties, or between Users and individuals to whom the User has granted permissions in the User Panel.
67. The User undertakes that his/her use of the Website, as well as the content of materials on the website, will not violate any legal provisions or the rights of third parties, including copyrights, industrial property rights, trade secrets, or personal rights.
68. The User undertakes that the materials and any other content transmitted by him/her via the Website will not contain any malicious software that may cause or threaten to cause disruption in the functioning of the Website or third-party products.
69. The User undertakes that when using the Website, he/she will not import, store, make available, or transmit any materials that may be harmful to minors, promote or incite sexual violence, torture, or hatred, including racial, ethnic, national hatred, or those generally recognized as harmful due to the principles of social coexistence, pose a threat to human health or life, violate privacy, violate public safety, interfere with proceedings conducted by authorized public authorities, promote illegal products or violate the ban on trading in products, indicate methods of endangering the security of the Website's operation, will not use the Website in a manner inconsistent with its intended purpose, will not use the Website to disseminate terrorist content.
70. In connection with the above-described obligations of the User, Wangog.pl has the following rights and the User has the following obligations:
a. if a third party brings a claim against Wangog.pl in connection with the violations described above, the User is obligated to cover the damage incurred by Wangog.pl as well as the necessary and objectively justified costs incurred in connection with defending Wangog.pl's interests. In the first instance, the User is obligated to take all actions and make every effort to release Wangog.pl from any claims filed against Wangog.pl in connection with the above violations, or to have them withdrawn or the User join Wangog.pl in the ongoing dispute, if any of these actions are legally permissible. All costs associated with taking the actions indicated in the preceding sentence will be incurred by the User at their sole expense.
b. in the event of receiving an official notification of the violations described above or an order from a competent authority or entity to block or remove illegal or terrorist content, Wangog.pl is entitled to prevent third parties from accessing the materials and to remove them completely.
c. in the event of receiving or obtaining reliable information about the violations described above or becoming aware of the illegal nature of the content, Wangog.pl is entitled to prevent access to the materials by third parties after notifying the User of the intention to prevent access to the materials.
71. Wangog.pl is entitled to suspend the operation of the Website or to modify the Website to the extent necessary - after notifying the User of the intention to suspend or modify it and requesting the removal of violations.
72. The User acknowledges that, if necessary for the safe use of the Website, Wangog.pl may temporarily block access to the Website in order to take appropriate preventive measures, of which the User will be immediately notified. Since this action is taken in the User's interest, the User consents to this and is not entitled to a refund of any fees.
73. Wangog.pl has the right to terminate the Agreement immediately in the event that:
a. maintaining the Website has become impossible for objectively justified reasons.
b. Maintaining the Website has become impossible for reasons attributable to the subcontractor Wangog.pl.
c. Wangog.pl terminates or suspends its business activities.
d. The User breaches the obligations referred to above.
e. the User grossly violates the rules of social coexistence or infringes the personal rights of Wangog.pl or persons acting on behalf of Wangog.pl or breaches the security of personal data of persons acting on behalf of Wangog.pl
f. the User materially violates the provisions of the Regulations.
74. The User is entitled to withdraw from the Agreement under the terms described in the Consumer Rights Act, unless he has previously waived his right to withdraw in the Survey.
75. On the date of termination or expiration of the Agreement, the User will be deprived of the ability to use the Website and access the materials and data collected on the website, which will be deleted. 
76. Wangog.pl processes Users' personal data in accordance with the principles set out in Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC and in the provisions of Polish law on personal data protection.
77. Detailed information on the principles and procedures related to the processing of personal data is provided by Wangog.pl in the Privacy Policy available on the website wangog.pl.
78. The User may submit a complaint. The User is obligated to cooperate with Wangog.pl to determine the validity of the complaint. The complaint should include the subject of the complaint, the circumstances justifying the complaint, and the request. The complaint should be submitted via chat. Complaints are reviewed within 14 days.
79. Subject to mandatory provisions of law, if Wangog.pl considers the User's complaint justified, the User will receive a refund.
80. Users communicate with Wangog.pl via chat available in the User Panel. Wangog.pl communicates with Users via chat, with a copy of the chat being sent to the User's email address.
81. Wangog.pl reserves the right to amend the Regulations or to repeal them and simultaneously introduce new Regulations. Amended Regulations are published on the wangog.pl website along with their effective date.
82. If a change to the Regulations, or the repeal of the Regulations with the simultaneous introduction of new ones, applies to Agreements concluded before the date of their publication on the website, information about the change or repeal will be sent to Users via chat.
83. Polish law shall apply to the assessment of the rights and obligations of Wangog.pl and the User, as well as to matters not regulated by the Regulations.
84. The court having jurisdiction to resolve any disputes concerning the Agreements concluded between Wangog.pl and the User is the court having jurisdiction over the registered office of Wangog.pl.
